HLA Hart tells us about how law would have emerged in a world of primary rules—informal, beneficial norms—by adjustments that the primary rules would naturally require; these adjustments would have introduced secondary rules for regulating the primary. But he does little to explain how the primary rules would themselves have emerged and, by most accounts, does not expand appropriately on the idea that the relevant players in his story would have taken an internal point of view, as he calls (...) it, on the rules involved. This article, presented as the Hart Memorial Lecture on 14 June 2018, argues that both problems can be resolved at once. Elaborating on Hart’s story with an account of how primary rules might have emerged, it also explains why those regularities would have attracted such a point of view. It argues that the emerging primary rules would have come to be perceived, internalised and ratified by all, and would even have been seen as rules to which each was personally committed. (shrink)

Upon the release of Brokeback Mountain, the conservative film critic, Michael Medved, in a television interview, predicted that a gay western – or maybe he called it a gay cowboy movie – would not attract an audience, presumably on grounds that the intersection of the audience for gay movies and the audience for westerns would yield, as the logicians say, the null set. Medved was proven wrong, as Brokeback, which cost $14 million to produce, went on to earn $83 million (...) on first release in the United States (plus $95 million abroad). But Medved was also wrong in his initial description. Although rodeos, horses, and cattle percolate through the film, Brokeback does not fit the classic American Western movie storyline. From the films of William S. Hart and Tom Mix down through Gary Cooper in The Virginian and High Noon, John Wayne in Stagecoach, Alan Ladd in Shane, and Clint Eastwood in The Unforgiven, the Western hero wears a cowboy hat, rides a horse, and carries a gun. His ultimate goal is to save the good folks from the bad guys, and he always succeeds. Brokeback, of course, is not like these films at all. Jack Twist and Ennis Del Mar are not engaged in the Westerner’s project of vanquishing evil. In fact, Ang Lee’s film more closely resembles the stories of such star-crossed lovers as Abelard and Heloise, Tristan and Isolde, and Romeo and Juliet. More interestingly, it fits a narrative pattern common in the nineteenth-century operas of Bellini, Donizetti, Verdi, and Wagner. In.. (shrink)

So it is perhaps not surprising to Wnd yEngland’s ygreat philosopher, Bertrand Russell, living in a little grey stone cottage on the side of a mountain and within sight of the sea. At a bend in a steep road, you suddenly come upon it: a typically Welsh looking place, for it is situated not far from the village of Llan Ffestiniogz—zin North Wales. It is small-scale country, this north-western corner of Merioneth: small steep hills; small glistening-green oak woods; small compact purple mountains (about 2,000 feet high). Ffestiniog village stands upon a ridge with a deep valley on either side; and a river, with white churning waterfalls, in each valley. From the grey stone terrace in front of Russell’s cottage, the whole Vale of Ffestiniog opens out to the shining estuary and the sea.2 The terrace has three tall, clipped, very prim looking bay trees; and all the cottage’s eight windows and two doors open out onto it; and Russell will tell you (with a lightly sardonic tone in his voice) that there were originally six trees, but that A.yS. Neill’s small scholars cut down three of them. (A.yS. Neill’s famous “experimental” school was evacuated here during the war.3 ) While Russell is himself an advocate of a very great deal of freedom in education, he thinks it is a pity if small children grow up without any knowledge whatever in their heads. Abstract:Spirituality is an undeniable human need and is thus the subject of increasing interest among management scholars and practitioners. In this article, we propose using archetypal psychology as a framework for understanding the human need for spirituality more clearly because it provides important insights into spirituality and organizational life. Because most spiritual needs reside in the deepest aspects of the self, an archetypal approach helps us recognize not only that we have spiritual needs but alsowhywe have them. We present three (...) common archetypes and their implications in a management context. That is followed by an application of the archetypal approach to some of the more spiritually corrosive aspects of organizational life and a discussion of the implications of archetypes as a source of motivation. In this synthesis, we summarize studies that yielded evidence of jealousy in young infants. To shed light on this phenomenon, we present evidence that jealousy’s foundation rests on history of dyadic interactions with caregivers which engender infants’ expectations of exclusivity, and on maturation of sociocognitive capacities that enable infants to evaluate whether an exchange between their caregiver and another child represents a violation of that expectation. We conclude with a call for greater study of the antecedents and sequelae of both (...) normative and atypical presentations of jealousy. In addition, we recommend approaches that address jealousy across a range of relationships, both within and beyond those which include attachment figures. (shrink)

In this essay I describe how my involvement in the political struggles of an immigrant domestic workers' collective inspired me to hang out not only with the workers, but also with the writings of María Lugones and Hannah Arendt. The essay invites the reader to engage in a playful rereading of Arendt's notion of the worldlessness of laboring in the private realm by putting her into dialogue with Lugones's notion of the hangout that defies the public–private split Arendt adamantly insists (...) on in all her writings. By following the complex physical, mental, and emotional itineraries of immigrant domestic workers to, from, and in-between a number of places and spaces, I demonstrate how their stories blur the line between public and private, and therefore also between the unfreedom of the body and the presumed escape into the political public. I describe the women's experiences as the living promise of a world that allows for an embodied fluid movement between labor, work, and the freedom “inherent in action” (Arendt 193, 153). (shrink)

Kai Nielsen’s recent book Philosophy and Atheism is discussed here. The main point is that Nielsen’s arguments against Christianity can be turned against his own rationalist atheism with similar results, namely that the position seems incoherent from its own point of view. Christianity is unempirical and irrational by certain arguments, but the position assumed underneath those arguments does not survive treatment by those same arguments. Nielsen’s dependence on arguments that undermine the position assumed in these arguments should make him open (...) to the suggestion that these arguments may not be relevant to the assessment of the validity of a religious position. Liberalism is no longer defensible as a strategy for coping with conflicts in a pluralistic society, but is itself one of the pluralities in conflict. Hence its strategy for coping with plurality---tolerant suspension or privatization of the deep commitments that are the roots of conflict, coupled with rational discussion to form a public consensus not connected to the plurality of commitments---can no longer serve as a common sense approach for all citizens. In this paper I explore as a solution the (...) continuation of discussion toward shared public policy, but now discussion openly tied to underlying commitments. Truth in this context is pursued not as a matter of argument, but as fruitful consequences of action. (shrink)
